What is Title IX?
Title IX of the Federal Educational Amendments of 1972 protects women in education. The law requires schools receiving federal funding to provide women with equal educational opportunities as men and provide an environment free from sexual discrimination and harassment.
What does the Biden/Harris rewrite of Title IX do?
The rewrite radically changes the definition of sex to mean “gender identity.” A student can identify as a man one day and a woman the next, so classmates have no idea what to expect or how to act. The rewrite lowers the standard of harassment, making it easier for leftist teachers and administrators to punish students who dissent. The rewrite also allows men into women’s spaces, such as bathrooms and locker rooms, depending on how they “identify.” This is aimed at the complete destruction of truth and women’s privacy.
How does the rewrite affect students?
The rewrite endangers your Free Speech. The rewrite aims to scare students into agreeing, or at least pretending to agree, with trendy gender ideology, like the idea that men can become women. The rewrite means you could be punished simply for using someone’s biological pronouns.
The rewrite also endangers your physical safety. It allows people to use the restroom of their choice, regardless of their biological sex. You could be punished for merely expressing that this makes you uncomfortable.
What does YAF’s injunction mean for me?
By joining YAF, you exempt your school from Biden’s horrendous agenda. The Department of Education cannot enforce the rewrite at covered schools. This protection is available for middle school through graduate students and is available for new YAF members. The injunction essentially creates an opt-in system, allowing YAF to submit a list of schools that its members attend and to update that list on a continued basis. The list will not identify members by name, it will only list the schools.

I read that my school had to be submitted to the court by July 15 to be covered by the injunction. Is that true?
No. YAF’s attorneys worked through the legal process to ensure maximum protections possible for YAF members, ultimately obtaining clarification that the preliminary injunction applies to both current and future members and that it can continuously update the list of schools as needed.
The preliminary injunction prohibits the Department of Education from implementing or enforcing the rewrite at all schools attended by any YAF member. YAF can and will continue to update the list of schools it provides to the district court unless an appellate court says otherwise.
How will my school know that the Department of Education can’t enforce its Title IX rewrite against students?
The Department of Education is tasked with ensuring that schools enforce the correct rules. Individual schools will not be notified by the district court or YAF that the Department of Education can’t enforce the rewrite. It is not known currently if the Department itself will notify schools or post a list of schools.
You have the option of directly notify your school and/or school district that it is covered by the preliminary injunction by providing it with a copy of the notice YAF files with the district court. Does my name become public if I join YAF?
No, the district court has asked YAF to submit the names of the schools attended by YAF members. YAF does not disclose the names of the members themselves.
What if I attend a private school?
Most private schools must enforce Title IX because most of them accept federal funding. If your school enforces Title IX, this injunction can apply to you.
