The Mine Safety and Health Administration – one of the many unchecked regulatory arms of the federal government – exerted self-authorized control over a trucking company, just because they sometimes transport coal. The regulator then issued citations. This new use of power violates constitutional separation of powers principles. YAF is asking the Court to find that this regulator had no authority to expand its own mandate.
