Last night, a federal court issued an injunction temporarily halting the Biden Administration’s radical new Title IX policies. These policies aim to allow biological males to use women’s and girls’ restrooms and locker rooms based on so-called “gender identity,” and enforce the use of preferred pronouns.

For now, while Young America’s Foundation’s legal partners work to permanently overturn the rewrite, this injunction exclusively applies to schools attended by the members of Young Americans for Freedom, Female Athletes United, and the children of members of Moms for Liberty.

The injunction stems from a lawsuit filed against the United States Department of Education, arguing that the Biden Administration’s Title IX rewrite exceeds the DoED’s statutory authority and violates the Administrative Procedures Act. These sweeping changes are a clear violation of states’ rights to create and enforce their own laws, impose undue administrative burdens, and violate the First Amendment rights of both students and educators. The court’s decision to grant a preliminary injunction is based on the strong likelihood that this case will ultimately prevail.
